REGULATIONS of RIVER MILL ASSOCIATION OF CONDOMINIUM OWNERS,

FOREWORD
River Mill is a
unique community within a community, where residents share and enjoy its common
property, amenities and quality living environment in a beautiful waterfront
setting. Because we live in close proximity with one another, residents also
share responsibility to follow the rules and regulations established by the
River Mill Condominium Board of Directors. These rules and regulations were
established to respect and protect the best interests of all owners and the
image of River Mill as a well-maintained and well -managed condominium
residence.
If a fellow resident or the
condominium management tells you that you, your tenant or your guests violated
the rules and regulations, please assume your responsibility to be a "good
neighbor" by immediately complying with the rules. By doing your part to be a
considerate neighbor and encouraging others to do the same, River Mill will
remain a desirable place to call "home". These rules and regulations have been
carefully considered to serve our community as a whole and will be strictly
enforced through the procedure outlined in this document.
DEFINITIONS
- Owner: person holding legal title
to a unit and responsible for providing a unit tenant with the rules and
regulations handbook
- Tenant: person renting or leasing
a unit from a legal owner
- Guest: person visiting a unit
owner or tenant

each unit (approximately 5x6 feet) that is part of the unit, but subject to
all rules, regulations and treatments of a limited common element
GENERAL
RULES
- Unit owners are
financially responsible for any damage or defacing of common elements done by
the owner, the owner's tenant or guests of the owner or tenant.
- Unit
owners/tenants must maintain the entryway adjacent to their units. Garbage,
storage boxes, wheeled equipment, clothing or offensive decor as determined by
The Board is not permitted in this area.
- Washers, dryers,
dishwashers, garbage disposals or other appliances that disturb residents when
in use, may not be operated between the hours of 10:00 PM and 8:00 AM.
- T.V.s, stereos,
radios, musical instruments, other sound systems, etc must be operated at a
level that does not disturb other residents.
- Eating or
drinking in lobbies, hallways or elevators is not permitted.
- Signs, ads,
antennas, etc. are prohibited in unit windows, entryways, and common or
limited common areas.
- Children are not
permitted to use hallways, lobbies, elevators, driveways or docks as play
areas or be left unattended without adult supervision in common
elements.
- Running is not
permitted in common element hallways.
- Smoking is not
permitted in common element hallways, stairwells, lobbies or elevators.
- Board/Management/Maintenance/authorized personnel may require emergency
entry to the units with the master key for health and safety reasons during
emergencies. Owners whose units are not accessible with the master key are
requested to provide operable keys to the Board. If the master key cannot
access a unit and an operable key is not provided, owners are fiscally
responsible for any damages from necessary forced entry.
- Owners/tenants of limited common
elements are
responsible for maintaining them with a well-kept appearance.
- Management/Maintenance/Board of Directors makes and enforces all
decisions relative to the overall safety, operation and upkeep of common
elements.
MOVING
PROCEDURES/DELIVERIES
- Owners must
notify Management at least 48 hours prior to anyone moving in or out of their
unit. Any damages
to common elements exceeding $50 will be charged to the unit
owner. (Copies of moving procedures are available from Management for
distribution to moving companies.)
- To avoid
interference with residential garages, vans and trucks must park on the
asphalt beyond the north tramway entrance, parallel to the garages, and as
close as possible to the grass area and entry door.
- Moving is only
permitted in the large elevator on the riverside of the building. Maintenance
will post temporary 'out of order' signs in the elevators during the
move.
- Owners are
responsible for protecting building and elevator walls, floors doors, carpet,
lighting, sprinkler heads, etc.
- To conserve heat
and air-conditioning, movers should limit the amount of time tramway doors are
propped open.
- Delivery of large items (furniture, appliances, etc) must be made
through the north tramway entrance and follow the procedure outlined in item
B. Damage to common elements caused by deliveries to units will be
charged to the unit owner.
- All moving or
cardboard cartons of any size must be broken down (flattened) and discarded in
the garages (#14 and #39) designated for refuse.
- A fine of $100 shall be levied
against any unit owner violating this "Moving Procedures/Deliveries"
rule.
GARBAGE/TRASH
DISPOSAL
- Owners/tenants
and their guests are responsible for proper disposal of their garbage, trash,
or refuse in designated bins provided in either of two garages (#14 and #39)
at the far ends of the south and north tramways. This includes bagged garbage,
items for
recycling, food and beverages and their containers, papers, magazines,
wrappers or any other debris or substance.

No garbage, trash
or refuse of any kind is to be left in common elements
- Garbage must be
put in plastic bags and securely tied. Food and beverage cans, glass, metal,
plastic, newspapers and magazines must be bagged separately and placed in the
appropriate designated bins. (Refer to the Oshkosh Recycling brochure
distributed to units.)
- All construction
debris from units must be taken off-site for disposal.
- Christmas
trees and items that leave debris must be bagged when transported in common
elements. Christmas tree disposal is permitted until January 15 in an
area designated by Maintenance.
VEHICLES/PARKING
- Vehicle parking under the main entrance canopy is limited to one car
for a maximum of ten minutes. Park as close as possible to the brick
supporting wall, allowing space for another car to access the entrance under
the canopy.
- Guest parking is limited to guests only in the designated spaces next
to the tennis courts. Local authorities will ticket illegally parked vehicles.
Long-term parking in guest parking areas is prohibited.
- Parking is only permitted in
designated parking areas.
- Commercial vans, mobile homes, boats, trailers, etc cannot be parked
outside of garages unless Management gives prior approval.
- Any type of vehicle or mechanical work is not allowed in parking areas
or driveways.
- The Association is not responsible for any damage done to parked
vehicles. Vehicles
must be moved when necessary for snow removal or maintenance
purposes.
- Storage of vehicles is not
permitted in any parking spaces. Vehicles may be towed at owner’s
expense.
- During boating season, the
first 6 parking spaces on the northwest side of the property by the pool are
reserved for dock renters.
GARAGES
- Conducting business enterprises from garages is
prohibited.

Owners are
financially responsible for damage to driveways or common elements caused by
fluid leaks from their vehicles.
- Use of appliances, heaters,
electric tools/machinery, etc in garages may be monitored and a minimum of $5
per month electrical costs assessed to the owner.
- Noise or odors from engine
revving, mechanical work or any other garage activities that disturb residents
is prohibited.
- Overhead and hallway access
garage doors must be closed when not being used for entry and
exit.
PETS
- One dog or cat,
not exceeding 20 pounds, is permitted.
- Aggressive or
otherwise unruly animals that are threatening to the safety of other
residents/guests, are destructive to common elements, limited common elements
or other residents’ property, or are generally disruptive to the quality of
living at River Mill are not permitted.
- Owners/tenants and their guests must immediately clean up their pet’s
excrement from common elements in a securely tied plastic bag and properly
dispose of the bag. Cat litter must be double-bagged for disposal in
designated garbage garages.
- Pets must be on a fixed leash in common elements.
- Owners/tenants must prevent pet noise, odors, nuisance, damage, etc
that impacts common elements or other residents.
- Pets must be attended while in garages, common elements or parked
vehicles.
- Owners/tenants and their guests are financially responsible for any
damage to common elements, including undue maintenance or replacement of
flowers, shrubs, trees, grass, etc.
RECREATIONAL
FACILITIES
All
facilities are for the use and enjoyment of owners/tenants and their
guests. Private use of these facilities by owners/tenants is subject to
prior Management approval. Any behavior that impacts the enjoyment or
safety of others using the facilities or River Mill residents is not
allowed. Any undue cleaning, maintenance or repair required of Management
or Maintenance after use by an owner, tenant or their guests is the financial
responsibility of the owner. Facility use for organized religious,
political and fraternal club meetings or for commercial or solicitation purposes
is prohibited. Owners give up all rights to use River Mill facilities when
they rent, lease, lend or otherwise relinquish occupancy of their
units. The Association assumes no responsibility for the safety of
owners/tenants or their guests using the facilities.
A.
Tennis Courts
- Pets and food or glass
containers are not permitted in the fenced court area.
- Recognized athletic
shoes, not street shoes, must be worn on the court.
- Children under 12 must
be accompanied by a parent or other adult who will be responsible for their
supervision and safety.
- Courts can not be reserved and should be vacated after one hour, as a
courtesy, if others are waiting to play.
- Players are responsible for removing their trash or any personal
items from the court area after use.
B.
Picnic Areas
(Located
in the open lawn area between the pool house and the community gardens on the
north side of the property.)
- The picnic area is
available for owner/tenant use daily from 8:00 AM until 10:00 PM.
Gatherings of
more than 15 people require prior Management approval.
- Guests must be accompanied by an owner/tenant. Loud, boisterous
conduct that is disruptive to residents is not allowed.
- Owners/tenants are responsible for their guests’ behavior and the
removal of all trash, food, drinks, cigarettes, ashtrays, containers, paper
products, lawn furniture, games, etc. after using the
area.
- If
used, the pool grill must be moved outside the fenced pool enclosure before
lighting. On the same day of use, the owner/tenant is responsible for
brush cleaning the grates and returning the grill to the designated pool
enclosure area clean and ready for use by other
owners/tenants.
C. Pool
Facilities
The pool is open May through September from 6:00 AM to 10:00 PM. (The
Board has discretion to extend this period if weather conditions are
favorable.)
- NO LIFE GUARD is on duty. Everyone using the pool and pool area
does so at their own risk.
- A common element key is required for pool area
entry. As required by liability
insurance and city ordinance, the pool gate must be closed and locked at all
times.
- Owners/tenants are
responsible for their and their guests’ behavior, damage to pool area
facilities and removal of all used trash, food, drinks, cigarettes,
ashtrays, containers, paper, etc. Common courtesy to other residents
dictates the number and frequency of non-resident guests.
- The pool can not be reserved for parties.
- Drinking, eating or smoking
in the pool is not permitted.
- Children under age 12 must be
accompanied and supervised by an adult responsible for their
safety.
- Animals and pets are not permitted in the
enclosed pool area.
- Radios, CDs, tape players, etc are not permitted,
unless used with ear or headphones.
- Running, boisterous conduct, unnecessary
splashing, ball or Frisbee throwing are not permitted in the pool
area.
- Devices worn for safety such as tubes, life
preserves, training rings, goggles, etc. are permitted in the pool.
- Rafts, flippers, toys, balls, scuba equipment,
etc are not allowed in the pool.
- Recognized swimwear is required in the pool - no
cutoffs. Infants/toddlers must
wear appropriate swimwear, such as Huggies Little Swimmers, not
diapers.
- For health reasons and to prevent clogging of
pool filters by body creams and oils, swimmers must shower in the outdoor
shower at the far end of the pool area before entering the pool.
- A telephone is available for emergency-use
only.
- Owners/tenants are responsible for cleaning up
after themselves and their guests. Food, drinks, cigarettes, ashtrays,
containers, paper products, etc. should not be left in the pool area.
DOCKS/PIERS
- Boat slips are for the sole use of
boaters who lease them and have agreed to comply with the rules and
regulations in the lease.
- Designated guest slips may not be
used on a regular basis or for more than several hours unless Management or
the Dock Master grants prior permission. An overnight charge may apply.
- Boats are not permitted to dock in
any area other than leased or guest slip.
- Refueling at the docks is
prohibited.
- Gear must be
stored and concealed in the lockers provided for the exclusive use of each
slip renter.
- Children under 16 are not
permitted unless supervised by an adult.
- Cleaning or feeding fish and birds
is not allowed.
- Running,
boisterous/noisy conduct, ball throwing, or other activity impacting residents
or other boaters is not allowed.
COMMON ELEMENT
LANDSCAPING/DECORATING
- The Board makes all decisions
and directs all projects pertaining to common elements. Residents are
encouraged to volunteer for Board-approved projects.
- Plots for resident gardening
are available on the north side of the property, east of the pool
house. Owners/tenants can reserve one of 20 sections in mid-May.
Gardeners are responsible for weeding, watering and keeping up the general
appearance of their plot.
EMERGENCIES
- In a severe weather threat or
when city emergency sirens sound, residents should proceed to the first floor
corridor with a flashlight and portable radio.
- Fire horns in the building will
sound when the sprinkler system or Common Element smoke detectors are
activated or the alarm handles in the Common Elements are pulled. The
alarm system automatically calls the Oshkosh Fire Department. NOTE:
Smoke detectors within units do not activate the building alarm system or
notify the Oshkosh Fire Department.
- To exit the building during an
emergency, use the nearest stairwell and proceed to the pool area on the north
side of the building. DO NOT USE ELEVATORS.
ASSESSMENT
PAYMENTS
Failure
to remit quarterly unit assessment payments within ten days after the due date
will prompt Board action to force collection of the delinquent assessments or
foreclose the lien, as provided by law. All legal costs, including
attorney’s fees, resulting from this action will be the responsibility of the
unit owner.
ENFORCEMENT ACTION FOR
RULES AND REGULATION COMPLIANCE

Owners/tenants will be given a verbal reminder by Maintenance,
Management or another resident that a violation of the rules/regulations has
occurred.

If the
violation is not corrected, a written warning to the owner and tenant will be
prompted by a written complaint to Management from another resident or
Management/Maintenance knowledge that the violation continues.
-
The
written warning to owners and tenants will state the rules/regulations being
violated, a date by which the violation must be corrected or damages paid, and
the imposition of a $50 per day/occurrence fine, if the date for correcting
the violation or compensating for damages is not met.

The
$50 per day/occurrence fine will be charged to the unit owner responsible for
the violation. The fine will be imposed for each day beyond the required date
for correction that the violation continues or for each time the same
violation occurs after a written warning has been issued.

If the
violation is not corrected, the fine is not paid or the violation reoccurs
after being corrected or a fine being paid, Management/Board of Directors has
the right to correct the violation and charge the cost of the correction to
the unit owner or pursue legal action against the unit owner and unit as
allowed under the law. The unit owner will be financially responsible for all
legal costs incurred by the Association to pursue such action.

The
Board reserves the right to interpret, amend or revise these rules and
regulations in the best interests of the Association.
